Article 1: General provisions



The e-commerce website of Space for Creation, a BV with its registered office at Blerebergstraat 24, 3390 Tielt-Winge, VAT BE 0508960483, RPR Leuven (hereinafter referred to as Seller) offers its customers the opportunity to purchase the products from its webshop online.


These General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via Giraffe BV’s webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Space for Creation.





Article 2: Pricing



All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.





Article 3: Offer



Despite the fact that the online catalog and the e-commerce website are composed with the greatest possible care, it is still possible that the offered information is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Giraffe BV. Giraffe BV is, as far as the accuracy and completeness of the offered information is concerned, only bound to an obligation of means. Giraffe BV is in no case liable in case of manifest material errors, typesetting or printing errors.


If an item appears without a selling price (e.g. €0), this indicates a computer error and the item cannot be sold at this price.


If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance.


The offer is always valid while supplies last and can be modified or withdrawn by Giraffe BV at any time. Giraffe BV cannot be held liable for the unavailability of a product. If an offer has a limited validity or is made under conditions, this will be explicitly mentioned in the offer.





Article 4: Online purchases



The Customer has the choice between the following payment methods:


  • Credit card
  • Debit card



Giraffe BV is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.





Article 5: Delivery and execution of the agreement



Items ordered via this web store are delivered in Belgium, the Netherlands and other countries as indicated at checkout.


Delivery is made by Bpost or another partner courier. Unless otherwise agreed or expressly stipulated, the goods are delivered to the Customer’s place of residence within 30 days of receipt of the order and payment.


Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to Space for Creation without delay.


The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by the Seller.





Article 6: Retention of title



The delivered items remain the exclusive property of Giraffe BV until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to draw the attention of third parties to the retention of title of Space for Creation, e.g. to any person who might come to seize articles that have not yet been paid for in full.





Article 7: Right of withdrawal



The provisions of this article apply only to Customers who purchase items online from Giraffe BV in their capacity as consumers.


The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.


The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.


To exercise the right of withdrawal, the Customer must contact Space for Creation, Bondgenotenlaan 128, 3000 Leuven, info@spaceforcreation.com via an unequivocal statement (e.g. in writing by post or email).


The Customer must return or hand over the goods to Space for Creation, Bondgenotenlaan 128, 3000 Leuven, without delay, but in any event no later than 14 calendar days after the day on which he communicated his decision to withdraw.


The direct costs of returning the goods shall be borne by the Customer. Returned items must be in original condition and packaging. Diminished value caused by handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods will be charged to the Customer.


Space for Creation will reimburse all payments received, including standard delivery costs, within 14 calendar days after notification of withdrawal, and may withhold reimbursement until goods are returned.


The Customer cannot exercise the right of withdrawal for:


  • Sealed goods not suitable for return due to health protection or hygiene reasons, where the seal was broken after delivery.
  • Goods that after delivery are by nature irrevocably mixed with other products.






Article 8: Warranty



Consumers have legal warranty rights under the Act of September 21, 2004 on consumer protection in the sale of consumer goods.


For items purchased online, the Customer must contact Space for Creation customer service and return the item at his own expense to Bondgenotenlaan 128, 3000 Leuven.


Defects must be reported within 2 months of detection. Defects arising from misuse, neglect, or abnormal handling are excluded from warranty.

Complaints can be sent to this address.





Article 10: Sanctions for non-payment



Without prejudice to other rights available to Giraffe BV, in the event of non-payment or late payment, the Customer shall owe interest of 10% per annum on the unpaid amount from the date of default, ipso jure and without prior notice.


In addition, a fixed compensation of 10% on the amount concerned, with a minimum of €25 per invoice, will be due.


Giraffe BV reserves the right to reclaim items that have not been paid for.





Article 11: Privacy & Data Protection (GDPR)



The controller, Giraffe BV, respects Belgian law regarding the protection of privacy and the EU General Data Protection Regulation (GDPR).


Collected data may include: identity details, contact details, order information, and browsing data.

Use of data: for order processing, customer service, legal obligations, and—if explicitly consented to—direct marketing (newsletters).


The Customer has the right to access, rectify, delete or limit processing of their personal data, and the right to withdraw consent at any time. Requests can be made by e-mail to info@spaceforcreation.com.


We treat all customer data as confidential and will not transfer, rent or sell it to third parties.


Customers are responsible for keeping login credentials confidential.





Article 12: Cookies



The website of Space for Creation uses cookies to improve user experience and gather anonymous visitor statistics.


Types of cookies used:

  • Analytical cookies (traffic statistics, e.g. Google Analytics)
  • Marketing cookies (only if consented, for personalized ads/remarketing)

Article 13: Impairment of validity – non-derogation



If any provision of these Terms is invalid, illegal, or unenforceable, the validity of the remaining provisions shall not be affected.

Failure by Giraffe BV to enforce any rights shall never be deemed a waiver.





Article 14: Modification of conditions



These Conditions may be supplemented or amended by additional conditions explicitly referred to. In case of contradiction, these Terms and Conditions shall prevail.





Article 15: Proof



The Customer accepts that electronic communications and backups may serve as evidence.





Article 16: Applicable law – disputes



Belgian law is applicable, with the exception of provisions of international private law on applicable law.


The courts of the Consumer’s domicile have jurisdiction in the event of disputes. The Consumer may also turn to the European ODR platform: http://ec.europa.eu/consumers/odr/.
